Terms of Use

1. Your Account

Sign In with Apple is optional. The full sound visualization experience (Lab mode) is available without an account. Sign In with Apple is required only for community features like publishing waves, commenting, following, and liking. Core visualization, microphone input, all visualization modes, and video recording work without an account.

Age requirement: You must be at least 13 years old (or the minimum age of digital consent in your country, whichever is higher) to create an account and use community features.

One account per person. Don't create multiple accounts to manipulate the community or circumvent restrictions.

Deleting your account: You can delete your account at any time from within the App. When you delete your account:

• Your profile (display name, bio, avatar) is permanently removed.
• Your published waves may be removed or anonymized at our discretion.
• Comments you posted may be anonymized (attributed to “Deleted User”) rather than fully removed, to preserve conversation context.
• Other users who saved your waves using “Use in Lab” retain their local copies. Your original display name may persist as a creator attribution on those saved copies.
• Purchases tied to your Apple ID are unaffected — they remain valid.

2. In-App Purchases

Cymatics Lab offers both free and paid features.

Free version includes:

• Square visualization mode
• Microphone input
• Basic controls

Cymatics Lab Pro — $9.99 one-time purchase — unlocks all current features, including all visualization modes, music integration, plate controls, studio tools, physics settings, lighting, and color customization.

24-hour free trial: New users receive full access to all features for 24 hours after first launch. The trial is available to both guest users and signed-in users. When the trial expires, the App reverts to the free version. Purchasing Pro at any point grants permanent access. Trial eligibility is tracked per device and per Apple ID. The trial cannot be restarted by reinstalling the app or changing device settings.

Future add-ons: We may offer additional features or content as separate purchases in the future. These will be clearly identified and priced at the time of offering.

All purchases are processed by Apple through the App Store. Refund requests must be directed to Apple in accordance with their refund policy. ShalaWorks does not process payments or issue refunds directly.

No subscriptions are currently offered. If subscriptions are introduced in the future, these Terms will be updated accordingly.

3. User-Generated Content

What you can publish

• Waves — visual presets that capture your visualization settings, shareable with the community.
• Profiles — a display name, bio, and avatar visible to other users.
• Comments — text responses on published waves.

Ownership and license

You own your creative work. Publishing content in Cymatics Lab does not transfer ownership to us.

By publishing content, you grant ShalaWorks a non-exclusive, worldwide, royalty-free, sublicensable license to display, distribute, reproduce, and promote your content within the App and in marketing materials related to Cymatics Lab (for example, featuring a wave in an App Store screenshot, social media post, or promotional video). This license continues even if you later delete the content, but only for copies already distributed or cached — we won't create new promotional uses of deleted content.

Attribution: Published waves include your display name as the creator. When another user saves your wave via “Use in Lab,” your display name is preserved as attribution on their local copy. This attribution may persist even if you delete the original wave or your account.

Our rights over content

ShalaWorks reserves the right to remove, restrict, or modify the visibility of any user-generated content that violates these Terms or that we determine, at our sole discretion, is harmful to the community.

4. Community Conduct

Cymatics Lab is a creative community. To keep it that way, the following are not allowed:

• Offensive or hateful content — including content that promotes violence, discrimination, or hatred based on race, ethnicity, gender, sexual orientation, religion, disability, or any other protected characteristic.
• Harassment or bullying — targeting, intimidating, or deliberately upsetting other users.
• Impersonation — pretending to be another person, artist, or entity.
• Spam — repeated publishing of low-effort, duplicate, or meaningless content intended to flood the feed.
• Sexually explicit or NSFW content — including in wave names, profile information, comments, or avatars.
• Intellectual property infringement — publishing content that copies or misappropriates another creator's work without permission.
• Profanity or slurs — wave names, display names, bios, and comments must not contain profanity, slurs, or other offensive language.

Consequences: Violations may result in content removal, temporary account suspension, or permanent ban, depending on severity and frequency. We aim to be fair, but final decisions rest with ShalaWorks.

5. Content Moderation

• ShalaWorks reserves the right to review, remove, or restrict any user-generated content at any time, for any reason, at our sole discretion.
• Reporting: Users can report content they believe violates these Terms and can block other users. We review reports and take action where appropriate.
• Abusive reporting: Filing false, frivolous, or repeated bad-faith reports may result in restrictions on your own account.
• No obligation to monitor: While we may review content, we are not obligated to actively monitor all user-generated content and are not responsible for content posted by users.

6. Third-Party Services

Cymatics Lab integrates with the following third-party services. Your use of these services is subject to their own terms:

• Apple Music — Subject to Apple Media Services Terms and Conditions. Requires an active Apple Music subscription for full playback.
• Spotify — Subject to Spotify's Terms of Service. Requires a Spotify account. Spotify Premium is recommended for full playback features. Spotify content is provided by Spotify AB. Powered by Spotify.
• iCloud / CloudKit — Subject to Apple's iCloud Terms. Used for syncing settings and storing community data.

ShalaWorks is not responsible for the availability, functionality, or terms of any third-party service. If a third-party service changes or becomes unavailable, certain features of the App may be affected.

7. Intellectual Property

Our property

The Cymatics Lab application — including its source code, Metal shaders, audio engine, user interface design, visual assets, and overall architecture — is the intellectual property of ShalaWorks. All rights reserved.

The Cymatics Lab name, logo, and branding are trademarks of ShalaWorks. You may not use them without our written permission.

What you may not do

• Reverse engineer, decompile, or disassemble the App or any part of it.
• Extract, copy, or reuse source code, shaders, or proprietary algorithms.
• Create derivative works based on the App's code or design.
• Use the Cymatics Lab name or branding to imply endorsement or affiliation without permission.

8. Acceptable Use

In addition to the community conduct rules above, you agree not to:

• Bypass purchases or trials — attempt to circumvent, manipulate, or exploit the purchase system, trial mechanism, or any feature restrictions.
• Manipulate the community — use fake likes, spam follows, coordinated inauthentic behavior, or any other method to artificially inflate engagement or visibility.
• Use automated tools or bots — access the App or its community features through scripts, bots, scrapers, or any automated means.
• Exploit bugs — if you discover a bug or vulnerability, report it to us at kevin@shalaworks.com rather than exploiting it. Deliberately exploiting bugs may result in account termination.

9. Disclaimer of Warranties

Cymatics Lab is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The App will be uninterrupted, error-free, or free of harmful components.
• Any defects will be corrected.
• The results of using the App will meet your expectations.
• User-generated content will be accurate, appropriate, or of any particular quality.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• ShalaWorks, Kevin Kiefer, and any affiliated parties shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• This includes, without limitation, damages for data loss, interrupted service, third-party service outages, loss of creative work, or reliance on user-generated content.
• Our total liability for any claim arising from or related to the App shall not exceed the amount you actually paid for the App (i.e., the purchase price of Cymatics Lab Pro, if applicable).

These limitations apply regardless of the legal theory (contract, tort, strict liability, or otherwise), even if ShalaWorks has been advised of the possibility of such damages.

11. Termination

By us: ShalaWorks may suspend or terminate your account at any time if you violate these Terms or if we reasonably believe your conduct is harmful to the community or to the App. We will attempt to notify you, but are not required to do so.

By you: You can stop using the App at any time. You can delete your account from within the App's settings. Deleting the App from your device does not delete your account or published content — use the in-app account deletion to fully remove your data.

What happens on termination:

• Your access to community features is revoked.
• Published content may be removed or anonymized.
• Local data on your device is unaffected.
• Purchases remain tied to your Apple ID per Apple's policies.

12. Changes to These Terms

We may update these Terms from time to time. When we do:

• The updated Terms will be posted within the App and at cymaticslabs.com.
• The “Effective Date” at the top will be revised.
• For material changes, we will notify you through the App (for example, via an in-app notice or prompt).
• Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

If you disagree with the updated Terms, your remedy is to stop using the App and delete your account.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

Any disputes arising from or related to these Terms or your use of the App shall be resolved in the state or federal courts located in Webb County, Texas (Laredo). By using the App, you consent to the personal jurisdiction of these courts.
